These Terms of Service ("Terms" or "Agreement") constitute a legally binding agreement between you ("you," "your," or "User") and BILENA TRADING LLC ("we," "us," "our," or the "Company") governing your access to and use of chroqbnos.com and any related services (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility & Account Registration

You must be at least 18 years of age to create an account and make purchases on our Site. By creating an account, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into a binding contract; (c) the information you provide is accurate, current, and complete; and (d) you will maintain the security of your login credentials and notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are engaged in fraudulent or unlawful activity.

2. Products & Pricing

All products are subject to availability. We reserve the right to limit quantities, modify or discontinue products, and change product descriptions without prior notice. Prices are listed in US Dollars (USD) and are subject to change. In the event of a pricing error, we reserve the right to cancel your order and issue a full refund.

Product images on our Site are for illustrative purposes. Actual product color, size, and appearance may vary. We do not guarantee that product images accurately represent the physical product.

3. Orders & Payment

When you place an order, you authorize us to charge your designated payment method for the total amount, including shipping, taxes, and any applicable fees. We accept Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, and Google Pay.

We reserve the right to refuse, cancel, or delay any order for any reason, including: suspected fraud, unauthorized use of payment methods, pricing errors, product unavailability, or violation of these Terms. If we cancel your order, we will refund the full amount to your original payment method.

4. Shipping & Delivery

We ship to addresses within the United States. Delivery times are estimates and not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier. For full details, please review our Shipping Policy.

5. Returns & Refunds

We accept returns within 7 days of delivery, subject to the conditions in our Return & Refund Policy. Items must be unused and in original packaging.

6. Product Safety & Usage Disclaimer

Our products are candle making tools, molds, and kits intended for crafting purposes. Some products involve heat, open flames, or hot wax, which carry inherent risks. You acknowledge that:

  • You are solely responsible for the safe use of our products, including following all instructions and safety guidelines.
  • Candle making involves melted wax at high temperatures — always use appropriate protective equipment.
  • Never leave melting wax or burning candles unattended.
  • Keep products away from children and pets.

We are not liable for injuries, damages, or losses resulting from improper use of our products.

7. Intellectual Property

"Candle Atelier," "Create Candles. Create Moments.," and all related marks are trademarks of BILENA TRADING LLC. All other trademarks are the property of their respective owners.

8. User-Generated Content

If you submit reviews, photos, comments, or other content to our Site (e.g., Maker Gallery), you grant us a non-exclusive, royalty-free, worldwide, perpetual, transferable license to use, reproduce, modify, adapt, publish, display, and distribute that content in connection with our Services and marketing.

You represent and warrant that: (a) you own or have the necessary rights to the content; (b) the content does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights; (c) the content is not defamatory, obscene, or otherwise unlawful; and (d) you have obtained consent from any individuals depicted in photos.

We reserve the right to remove any user-generated content at our discretion without notice.

9. Prohibited Activities

You agree not to:

  • Use our Services for any unlawful purpose or in violation of any law.
  • Attempt to gain unauthorized access to our systems, accounts, or data.
  • Interfere with, disrupt, or overload our servers or network.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall BILENA TRADING LLC, its officers, directors, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, or business interruption, arising out of or in connection with your use of our Services or products, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from these Terms or your use of our Services shall not exceed the greater of: (a) the amount you paid for the product(s) that gave rise to the claim, or (b) $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless BILENA TRADING LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any law or third-party rights; (d) any user-generated content you submit; or (e) any product you manufacture using our tools and subsequently sell.

13. Dispute Resolution & Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or our Services ("Dispute") shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in Denver, Colorado. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver: You and we agree that each party may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims.

Exception: You may bring a claim in small claims court if it qualifies, and nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for intellectual property infringement.

30-Day Notice: Before filing for arbitration, the party must provide written notice of the Dispute to the other party and allow 30 days for good-faith resolution.

14. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. For claims not subject to arbitration, the exclusive venue shall be the state and federal courts located in Denver County, Colorado.

15. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government actions, labor disputes, power outages, internet or telecommunications failures, or supplier failures.

16. Electronic Communications & E-SIGN Consent

By using our Services, you consent to receive communications from us electronically, including emails, text messages, and website notices. You agree that these electronic communications satisfy any legal requirement that communications be in writing. This consent applies to order confirmations, shipping notifications, policy updates, and marketing communications (which you can opt out of at any time). You may withdraw this consent by contacting us, but doing so may prevent you from using certain Services.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy, Return & Refund Policy, and Product Safety Warnings, constitute the entire agreement between you and BILENA TRADING LLC regarding your use of our Services and supersede all prior agreements and understandings.

20. Promotions & Discount Codes

From time to time, we may offer promotional discounts, coupon codes, or special offers. The following terms apply to all promotions unless otherwise stated:

  • Only one discount code may be applied per order. Multiple codes cannot be combined.
  • Discount codes cannot be applied to gift card purchases, clearance items, or orders already discounted through a separate promotion.
  • Discount codes have expiration dates and may be revoked or modified at any time without notice.
  • Minimum purchase thresholds, if applicable, are calculated on the product subtotal (before shipping, tax, and after other discounts).
  • We reserve the right to cancel any order that uses a discount code in violation of these terms or the specific promotion terms.
  • Free shipping promotions apply only to standard shipping within the contiguous United States unless otherwise stated.
  • Some promotions may be limited to specific products, categories, or customer segments (e.g., new customers, newsletter subscribers).

21. Subscription & Recurring Orders

If we offer subscription or recurring order services in the future, the following terms will apply:

  • By enrolling in a subscription, you authorize us to charge your designated payment method on a recurring basis (monthly, quarterly, or as selected) until you cancel.
  • You may cancel your subscription at any time by logging into your account or contacting us at support@chroqbnos.com. Cancellations must be made before the next billing date to avoid being charged for the next cycle.
  • Refunds for subscription charges are handled in accordance with our Return & Refund Policy. Partial cycle refunds are not available.
  • We reserve the right to modify subscription pricing, products, or terms with at least 30 days' notice via email before the next billing cycle.
  • Subscription services are subject to availability and may be discontinued at our discretion with pro-rated refunds for any unused paid period.

22. DMCA & Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. If you believe that content on our Site infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) takedown notice to our designated copyright agent:
